UK CAR ACCIDENT INSURANCE CLAIM ADVICE

People who travel in a vehicle as a passenger are typically in a very strong legal position to make a car accident insurance claim for compensation. Almost without exception the passengers in both vehicles involved in a collision can make claims for compensation for personal injury from one or other of the drivers or if the accident was contributed to jointly by each driver then the passengers can claim a percentage from each driver. It does not matter who was to blame the passenger will always be paid out even if the driver of the car in which they were travelling was to blame or was a friend or close relative. One spouse can claim damages from the other and children can claim against parents and vice versa.

Compensation in a car accident insurance claim, is for the sake of convenience, divided in to two categories – ‘general damages’ and ‘special damages’. One represents the types of damage which are specific and easily quantifiable such as the loss of income you have sustained from being off work or the cost of repairing a piece of property. The other represents less easily identifiable forms of ‘damage’ such as physical suffering and mental anguish which must be assessed rather than be exactly calculated.

The Limitation Act 1980 applies to a car accident insurance claim and it determines the applicable time limits for making claims for personal injury which must be either settled or legal proceedings must have been issued within three years of the accident. There are exceptions to this general rule for those under the age of 18 years at the time of the accident, for those who are mentally disabled and in cases where the injury was not apparent immediately following the accident. Failure to abide by the time limits may mean that the potential claim becomes statute barred and the opportunity to claim compensation may be lost forever. If in any doubt about these matters take immediate qualified legal advice.

Our network of specialist solicitors exists to help individuals know what legal options they have and how to protect their right to compensation. All of our solicitors are specialist members of the Law Society panel of personal injury experts and also members of the Association of Personal Injury Lawyers. We operate the no win no fee scheme and our solicitors never require clients to pay any money to help fund or finance their claim. Whatever the result of your case you do not pay us anything. Compensation is paid in full with no deductions.

If you feel that talking with an expert solicitor might be helpful then there is no better time to do so. Our experts talk only in plain English and do not use any complicated legal jargon. We will answer your questions and provide you with the information you need to make your decision. Our advice is completely free and there is no obligation to use our services further. Just complete the claim form or use the helpline and a specialist personal injury solicitor will give you free advice.
