UK MOTOR INSURERS BUREAU CLAIMS

    Uninsured Drivers
    If the driver of the other vehicle was uninsured but identified at the time of the accident, an application for compensation can be made to the Motor Insurers Bureau. In these circumstances it is necessary for a judgement to be obtained in a court of law against the third party. Once liability has been established in this way the matter is assed by a judge who will make an award of compensation which will be satisfied by the MIB who also pay the solicitors legal costs. The MIB will thereafter attempt to recoup the money that they have paid out from the uninsured driver but this need not concern the claimant.     Untraced Drivers
    If the other driver was untraced or unidentified a claim can still be made for losses resulting directly from any injuries sustained. However damage to property, including damage to vehicles, may not be recovered in hit and run cases. The Motor Insurers Bureau investigates liability and the value of the claim prior to making an award, but if their decision is not found to be satisfactory an appeal may be made. The MIB will not pay all legal costs incurred, but they do contribute to them, and any legal charges incurred in excess of the MIB contribution will be deducted from the total of any compensation award.
